How is it any different to players having relegation clauses in their contracts that allow them to leave the club for a reduced fee upon relegation? It is nearly impossible to remove all conflicts of interest.
Because this is a specific arrangement with a team in the same division, not a general clause for a player to go anywhere for a reduced fee on relegation.

I don't understand how that makes any difference, what relevance is it that we are both in the same league? The conflict of interest clearly exists for the player in each scenario.
 
I know he’s signed his contract with us and done some media and photos. As far as I’m aware it’s just formalities on the Villa end. I did think it would be sorted by now though. It will still go through though no need to worry.

Hecky was happy to talk about Archer in his press conference rather than his usual no comment on other clubs’ players.

So for that reason, I’d be amazed if it didn’t happen.

Kompany spoke about Ramsey a week before he was officially announced as a Burnley player as he needed to negotiate his salary etc with Villa in the event the buyback clause is activated. The deal was agreed between Burnley & Villa but Villa and Ramsey had to agree the potential buyback salary for the sale to go through. So I agree, this deal will happen

The implication is that in complex issues such as these ( as you will so readily acknowledge from your tax law expertise) SUFC at basic ground level does not seem to have the ability to agree and close a watertight deal in a reasonable time frame. Now it might be a problem from other parties, but please excuse me for having what seems to be a well founded doubts about the time taken for this to go through bearing in mind all the bollocks from the club mouthpieces. I repeat. Who are the club’s advisers. You seem to know.

The club, in common with all but a handful, doesn’t have an in house legal team, so they rely on external legal advisers, especially on something like this deal, which is out of the ordinary. So the club doesn’t have legal expertise at “basic ground level” and doesn’t need to. But clearly you didn’t know that before you spouted about “Bettis & his ace legal team”.

For things that are sport specific (rather than property etc) there are a few firms of specialist sports lawyers. They tend to be very good. In common with most clubs, United will engage them for different aspects of sports law. If you are that bothered you will be able to find out the firms that United use quite easily. But it would be a bit pointless because there’s nothing to find that you would be able to attack the club with.

I hope United’s lawyers are crawling all over this deal. I expect that might even be part of the reason for the delay. That’s good, I would prefer that to rushing through a complex and unusual deal and messing it up.

If we are relegated the FFP Prem rules , not that we are breaking then anyway,would not apply to us as we are then in the Championship? Or are they the same ?

Why is there? He can still sign our contract before the deal is done it’s not binding until the deal completes. Basically all our bits are done medical contract etc.
How can a signed contract not be binding? What is the trigger for the deal to be completed?
 
AHH now I get it, Archer is on loan who bought a loan from a mortgage broker in the early hours of Easter Sunday morning to ratify the loan to be used on any Sheffield roundabout except Meadowhead between the hours of 8am and 7pm.

But it's clear to me that this is a deal and agreement different to any I've heard of.

Therefore, I'd rather all the finer points are nailed down legally before we leave ourselves open to any recourse.

Wouldn't that just be the club's issue and they still have a binding contract with the player if the player is not registered? Doesn't registration just allow the player to play for the club, if he can't be registered does the player not still become an employee of the club albeit a not very productive one?

No.
My assumption is that until his registration moves over to us, which presumably is via a fully-executed contract inc. EPL sign off, his registration remains with Villa.
The deal isn't fully-executed until registered with the EPL.
