Two thingsCharge upgraded to Assault by Beating from Common Assault. Seems the CPS are going all out to get a conviction. Assault by beating indicates force was used which could be as little as pushing, grabbing someone or spitting at them. The grainy video suggests some pushing but the grabbing was definitely done by Brewster. It seems there is a 13 year old witness to the alleged assault. How credible their evidence is bearing in mind he will also be a Florist fan committing a criminal act by invading the pitch remains to be seen. It is possible this could be the person who took the grainy video.
Mcb has righty pleaded not guilty so the trial is moved back to 7 December.
I'm no fan of Mcb's footballing abilities but lets put some context here before the usual cries of lets get rid of him, he's a bad apple etc.
Nottingham Forest are guilty of failing to control their fans and allowing an illegal pitch invasion. Yet inexplicably even now the FA for reasons unknown are dragging their feet yet see fit to charge, Everton, Bristol Rovers and Huddersfield for the same offence. Mcb's actions have no bearing on a charge against Florist under FA rule e.20.1.
Hundreds of Florist fans carried out criminal actions in invading the pitch some threw smoke bombs into the away end yet no action has been taken by Notts police force unlike West Yorks police who are actively pursuing individuals.
A serious assault occurred on SUFC's captain and SUFC players and staff have said they were attacked and feared for their lives as stewards and police did nothing to protect them. Whilst Sharps perpetrator was dealt where are the investigations into these other concerns?
Against this background Mcb is involved in an incident with a Florist fan who ran towards SUFC players. There is an argument to say there were considerable mitigating circumstances leading up to the said incident.
No doubt the court of public opinion will convict Mcb before his trial simply because he's a bad boy. I've more faith in the legal process and its best to wait until the case concludes before jumping to conclusions about the outcome. Everyone is innocent until proven guilty and the conviction will only happen if the 3 Magistrate judges believe the evidence proves beyond reasonable doubt the alleged assault occurred.

Plus the only time McBurnie has 'hit form' during his career was during his time at Swansea!

Common assault is a summary offence and only heard at the Magistrates Court. Now the charge has been upgraded to Assault by beating this is an either way offence that could be heard in either the Magistrates or Crown Court. I share your sentiments about magistrates. An appeal would go to the Crown court if the decision is disagreed with where no mistake by the magistrates has occurred.Two things
First, a question. Could it be requested that it’s moved to Crown Court? I’m not a fan of magistrates - part timers. Or would it be a case of having to appeal if found guilty?
Second, I think it’s time our local press made a bit of an issue of this, particularly why Forest haven’t been charged.

You are what you eat…..Yet for all the flack that pudding Mousset got with us, I noticed he scored 3 in 7 last season for us despite us getting rid of him for the rest of the season.
