We would have to pay his wages if and until he is found guilty and then would be able to sack him on all sorts of grounds - the main one being that he can't actually perform his side of the contract as he will be in prison!

We wouldn't be able to get the wages back we paid whilst he was on bail as, at all times during that period, CE was (I assume) ready and available to perform his side of the contract.

On that latter point, what would happen if Ched declared himself mentally unfit to play? (unlikely to happen I grant you...)

Obviously, he would not be so daft, but I assume if he got a medical certificate to that effect, we would have to pay him in the same way as if he was injured. Whether we could then get that pay back if he was found guilty on the grounds that this mental unfitness was self inflicted is debateable. I suppose Ched would argue that trying to treat him as guilty at a time when he was, in law, innocent, would undermine a fundamental principle of British justice etc etc.

I wouldn't advise United to sue.

Yes and no. Unless there is something specific in his contract that says "if you are on bail for a criminal offence we won't pay you" (highly unlikely), then the above would apply.

Note that we don't even appear to have suspended him which suggests that we can't avoid paying him.
 
I personally think that ched has got to be innocent, the main reason being he could't put owt in an opening 12ft wide, what chance him "hitting the target" when its just a couple of inches? and lets be honest the guy couldnt rape some pretty shit defences last season :(
and if he is innocent id like him to stay (reduced contract of course) because i honestly believe we have seen nothing from him yet (i really mean this) and i think if he gets scoring n league one, confidance boost n all that, i think he will kick on and score in championship when we get promoted :)

All this slating of Evans constantly, but he had the best league goals per game ratio for any player in our entire senior squad last year. Not counting Slew as a youth player really, he had 1 in 3.50 (2 in 7 games).

Cresswell - 1 in 7 (5 in 35 games)
Bogdanovic - 1 in 6.4 (5 in 32 games)
Henderson - 1 in 4 (2 in 8 games)
Evans - 1 in 3.77 (9 in 34 games)

So people can moan about him all they want, as he hasn't reached the heights we were hoping for yet but I'm confident he'll score goals at this level once he's (hopefully) proven innocent and gets fit. Especially in a team that is now trying to play football. And hopefully that breeds confidence and more goals if we do get back up!

erm...just a thought here, but i dont seem to be able to find anywhere against who/what the charges relate.
doesnt actually state that he raped a woman from what i can see, anyone shed any light onit it was male/female/bovine/canine etc etc.

A mate of mine did two years of a five year stretch for rape a few years back before the lady concerned admitted she had made the whole scenario up to convince her boyfriend she hadn't been shagging behind his back. He was/is a good bloke, just like one of us, a military officer who had his life ripped to pieces over one unlucky decision that, by the grace of God, could happen to almost any lad. Rape is a vile term that encompasses a bewildering range of scenarios almost all of which don't apply to Ched Evans. Give him a break, at least until he has chance to defend himself.

I suspect the story may be slightly aprocryphal. If she admitted to the police she had made the whole story up, she would have gone down for a number of years for perjury. Which begs the question as to why, if she was so evil in the first place, so would, after two years, admit what she had done and send herself to jail.

"Going down" to mean oral sex is an Americanism. In my neck of the woods if you say someone is going down they are having a spell as a guest of HM.

Quick question for someone who knows better than me (Darren! :D) ...

Obviously, we have to stick with Ched for now as he is innocent until proven guilty. Unless Ched agreed to leave by mutual consent - which ain't gonna happen - we're 'stuck' with him.

What happens if he is found guilty though and banged up? I'm sure that we could sack him at that point but would SUFC be entitled to getting his wages back? For example, if he was mentally unfit to play, could we have an argument that he caused it himself and retrieve the 'lost' wages?

For the record, I hope he is not guilty. Football is not the point here. Whether Ched is a striker earning 20K a week or a labourer earning £150 a week, it is irrelevant and I hope the lad is innocent.
