" A man who is attacked or believes that he is about to be attacked may use such force as is both necessary and reasonable in order to defend himself."

Thousands of opposition fans illegally encroaching onto the pitch, a player publicly stating they feared for their lives amid police indifference coupled with a violent assault on the skipper all seem valid reasons for believing you are also about to be attacked.
The problem comes when you have footage that appears to show a player stamping on a fan who’s laid on the ground. That is then beyond somebody doing something that is reasonable to defend themselves and would fall more within the realms of excessive force.

The club should just sack McBurnie and use his wages to pay someone who might actually make a decent contribution to the first team next season.

Even if it did go to a jury trial which seems to be a bit speculative, is it likely that the jury would have any Blades or Florists on it?!

I think you’ve missed my point, although it would be likely if in Nottingham.

My client is of previous good behaviour M'lud....

A man, nay a saint, dressed in the best finery from the leading Hoollie wear companies in Europe, now heartbreakingly bereft of his Rolex collection, his only childhood friends. accused of the crime of self defence against a scabbing dog nonce who shouldn’t have been on the pitch in the first place! Your Honour. May l also suggest to the court that my client says if the barrister for the prosecution refers to him as McDogshit once more, he’s going to get his four eyed fucking head stamped on.

Oh, err, the plea is Not Guily……

This please..

Perhaps I am wrong to link it but if you remember the Ched case. The girl never pushed the charges, it was the police / CPS who wanted a Celebrity conviction. There seems to have echos of that here. Where's the glory in charging a bunch of nobodies?

Yeah good luck with that one 🤣🤣🤣🤣

I'll turn up at the hearing with the judge's favourite chai latte and smooth talk them out of McBurnie doing serious time in pokey. Not worried about Brewster, that baby face will melt hearts.

Well, you convinced me. But, just to be on the safe side, let's check which countries we dont have an extradition treaty with....

As the nature of charges are now out in the public domain it may not be appropriate to comment publicly on the perceived individual circumstances of the case. Section 39 common assault, if that what the charge is, is the lowest form of violence to the person. Normally charged where no serious injury but lesser injuries such as bruises/grazes occur.

As they are likely to plead not guilty at the Magistrates Court Hearing on 28 July the case will be adjourned for a later date. It will then be decided which Court it should be heard in. Crown Court only hears trials by jury.
common assault is summary only so the trial will be in the magistrates court if that is what they have been charged with.

I can't wait for our own club to reward these loyal Forest fans by say giving them our kop the next time we play them in Sheffield. Perhaps we could move every single season ticket holder as well because they deserve it for Clough and being good 40 years ago. Beyond a joke if we are not taking them and the league to court over this

The police could be held responsible for inciting violence, because as sure as I am sat here it will kick off in a big way the next time we play forest.
Most had put it to bed but unfortunately not now

As much as I agree with you here, that's not always the case. The police can still pursue a charge.
I agree, but the Police or CPS, would rarely, if ever, pursue a ‘non domestic’ assault, where the complainant declines to prosecute.

Which I believe was the case with Patrick Vieira

Bladeloyal I agree with Snowflake

Anyone inside a football ground, behaving (for eg) like a deranged steelworker type, and captured on CCTV & video, would expect to be arrested, charged & convicted.

That's not a stitch up, that's bang to rights.
Subsequently after a channel four documentary all charges rebuffed ,DST

Sorry to disappoint you but you are unlikely to find a judge in the Magistrates Court for this type of charge.
However if there was a lady magistrate then I am sure your charm and good looks would easily lead to acquittals
