Thanks. I'm way out of my depth. We were going to sue West Ham because something they did denied us the revenue we would have earned in the Premier League. My knee jerk assumption was that if .... a key player was sidelined because of negligence by another club, they might be able to sue for the revenue they missed out on. But, that's just my invented lay person understanding

You sue in the civil courts.

Our case against the CheatinAmmers was that they had acted in bad faith, when as follow PL members, they had a duty to act in good faith toward all other clubs.

So, if a business (football club) is disadvantaged financially by the negligent actions of another business (football club) - surely they can seek financial compensation. How would they seek that compensation? (all hypothetical of course)

There is a complication that on the field events are goverened by the FA in the first instance. They will investigate and punish and all clubs have to abide by this. If say Villa chose a different route, they could presumably leave themselves open to action from the FA (guessing here as I don't know the details of what all EFL members have signed up to). Proving negligence on BCFC's part will be tricky. If they have the right number of trained stewards that their local SAG sugest, then it will be even harder.

I just feel that the insane amounts of money involved & the insane financial risks clubs & owners are taking to grab Premier League money, mean that it's inevitable some insane litigation will happen one day. But, your clarification is welcome

They seem to be saying one can. I have a vague recollection from when I studied (basic) law that assault can be a tort as well as a crime.

I don't agree completely. I believe in collective responsibility, which is quite unfashionable, I know, but in the case of a football club there is a football supporting culture that develops amongst the fans. Clubs have worse reputations than others; as has been pointed out, he was cheered on, not booed off. These things have to be judged case by case, but I don't see anything wrong with a punishment that affects the whole club in this instance.

Just seen the Birmingham lad got 14 weeks in HMP this afternoon. 350 quid fine & costs which includes 100 to Grealish - for "pain, discomfort & shock".

Also a 10 yr ban from all grounds and a life ban from Birmingham. His family have left the area in fear of reprisals.

He "cannot explain what came over him yesterday morning", his solicitor said.

"His initial foolish intention was to just go on to the pitch and whip up the crowd," said Vaughn Whistance, defending.

Probably lost his job too and will find it extremely difficult to get another.

Well that's quite a leap to get to, docking 10 points. That's a punishment that's hardly ever doled out for anything, so to build the argument that it would be unfair to dock the club 10 points for you just running on the pitch (which is a lot less than happened here) is a bit OTT. I would expect the punishments to build over time if clubs are identified as having problem fans and security issues. Fines to begin with, demands for proof that the club is operating sound security systems, if not stands closed or matches behind closed doors, if that doesn't work then move on to points deductions, starting with 1, then going higher. If over a period of years the club and particularly the fans have had plenty of warning and still persist then ultimately, yes, 10 points or automatic relegation.
