It seems those running the day to day are seeing a need for a further 7m investment in the summer for Chris with only 600k incoming to offset that. This seems to be disputed on the Prince's side and for that reason I'd rather Kev wins.

It is stated that one player sale could offset this. Let's hope that Che goes for 20m and Brooks gets offloaded for 40m and Maguire gets his move to Man U!

It also mentions how the Prince moved shared from one company to another to disrupt McCabe's attempt to get shares back. With all those shares not in one place it would diminish the Prince's need to outright acquire everything.

All very messy and acrimonious.

Don't get that at all. Mentions need $7m in "current transfer window" to fund promotion activities Was that written retrospectively relating to Jan or looking forward to summer on the assumption we're still in the championship?

The Judge is quoting from what was said in June 2018 by a different judge. There is very little new factual information in the judgment.

The judge in the linked judgment from 9 April decided 2 things:

1. first, whether the McCabe camp could amend its case slightly. Most of the proposed amendments were allowed.

2. second, whether the McCabe camp were entitled to see certain documents held by the Prince's camp. There was a discussion about Legal Professional Privilege, i.e. the rule which holds that documents contain confidential communications between a lawyer and his client concerning legal advice need not be disclosed. Complications arose because one of the partners at Jones Day, who represent the Prince, acts not only as his lawyer but also assists in a business capacity, where no privilege would arise. In the end, the judge held that the McCabe camp were not entitled to see any of the 5 categories of documents they had sought.

The trial will apparently run for 25 days. That's David Brooks transfer fee money being spent on this matter, then.

3 takeaways for me from all of this:

- the McCabe camp are fishing for evidence to make their case better
-the parties are needlessly complicating the matter by throwing in loads of peripheral or irrelevant arguments in an attempt to blacken the name of the other side. This is in my view a waste of time and costs, and sometimes a sign of a weak case.
- the litigation has become very personal
 
I might add, before the McCabe Wumaos go beserk, that I am not saying that the actual Brooks transfer fee is being spent on this litigation. Of course not. I meant that a sum approximate to that is being spent by the two sides combined.
 
Looking at the judgements so far not much Going McCabes way ,some major egos out there.

Hull may well benefit but how would Utd get anything should Maguire move again over the summer? Surely any sell-on entitlement will have been realised when he moved to Leicester.

It appears McCabe has been out-manoeuvred by HRH and his Legal Team and trying to dig-up dirt is a final act of desperation.

What happens to the club no matter who wins the case nobody knows - it just appears more and more likely thay the club will end up in the hands of someone who sees it as a business opportunity rather than a club that plays an important role in the community and local area.

The van Winkel debacle has clearly been rumbling on for a while. No doubt the Prince wanted him through the door and all seemed set for him to operate as a DoF until McCabe pulled the rug from under it - he was then subsequently shuffled off to Belgium until this all gets sorted. If Princey wins this case he’ll be back at the Club with days I’d well imagine (not that I think that’s a terrible thing, we do perhaps need someone with world football knowledge to take us to the next level IMO).

I can’t say I warm to either man but I think McCabe is the lesser of two evils at present.

I think.... and i'm sure someone will correct me, there's solidarity sell on clauses when a player is trained as a youth at a club, I think it's a very small percentage but is applicable to subsequent transfers, but i'm not sure how many that equates to?
 
On a very simplistic view, it strikes me that what Kev is trying to do is set up a prior conspiracy to "defraud" in his attempt to show that the share shifting was unlawful. That, according to the Court is the real issue. The apparently privileged documents will no doubt contain some advice that there was, on the basis of the written agreement, a subtle if not wholly moral way of sidestepping it.

Bloody proportionality. Forrins concept. Not proper English law.

Gonna be a blood bath this case.
 
Will it get sorted in May? Anyone know how long these hearings go on for? Last thing we want is for it dragging on into pre season...

Trouble is, HRH wins, we have new owners, KM wins, do you really think he's going to rush into another deal (unless he has someone else lined up) ?

and. of course, the next few weeks on the pitch will have a massive impact.

Wasn't there a claim of an email Kev was copied into by mistake? Could this be a smoking gun and could SUL use it? Are dogs allowed in the courtroom?

If HRH wins, we have an owner without a pot to piss in, and I don't think either Kev or HRH have the funds to get us through another season in the championship unless someone knows something different.

My only hope is that if HRH wins he has some very wealthy contacts! I can’t see either man holding onto the Club for long.

It will run for 5 weeks. Well, that's what it's timetabled to run for. It could be longer or shorter.

Then it will take a while for a judgment to be written. A couple of months, at least.
 



The season ticket money will be in by May. Boycotts will have little or no effect.

No more funds, Wilder walks. Players sold from under him, Wilder walks. HRH wins, in comes Winkel, Wilder walks. As fans we're more impotent than ever.

Dark days ahead without promotion, possibly even with.
