There is no problem with it. All he has to sign is conformation of the terms he'd be agreeing to if the buy back was needed.
The contract with Villa is not an active contract.
Don't recall hearing any player previously having to sign a contract with the club he's leaving in the context of a potential buy-back. Eg, don't recall Brewster having to do so.
This appears to be inking something in far more specifically and linking it to one club's performance in the same league as the selling club.

If it were that simple Couldn’t they have just faxed contract to us for him to sign? Oh, wait a minute……
 

Subsequently assume that Brewster had to sign A contract with Liverpool which would have become active if he were to have been bought back, but cannot recollect any reference to this

I'd say he didn't as that was an option rather than an obligation.
 
Thinking about this buyback deal with Archer. In short, Villa could be saying to him "Go to BDTBL and get them relegated and we'll get you straight back and give you £20k-£30K a week more". Surely Prem league need to be investigated these deals because they are open to abuse.
And sacrifice his own personal career in the process? Very much doubt that

Seems a lot of fucking about when we’re odds on to go down anyway
 
I am sure there are easier ways to make money like bet on yourself being booked first minute and get someone to put 100k on it

Unless he is going to sabotage the whole team's performance then I don't see how this would even be possible? Yeah sure he could miss a few sitters, but if that kept happening he would soon be warming the bench anyway. He could then also kiss any prospect of an England call up goodbye, but of course he will be able to afford a few more Bentleys, so life is good.

OK, not get them relegated but can see players not busting a gut knowing what's available no matter what the outcome.
