The 'chokehold' caused the man to fall to the floor

The man (Mr Brinkley) fell to the floor after the chokehold, then McBurnie stamped on him, added Mr England.
Asked by Mr Jones if he had a clear view of this, he replied: "Yes". Mr Brinkley was lying on his back.

What he saw

He described events leading up to the incident and how Brewster, a Sheffield United player, had got hold of somebody he did not know and threw him to the floor. He described it as a "chokehold from behind".

How could he see this on the floor when the incident was surrounded by 100s of fans. If he was next to it, why didn't he intervene? or did he ?

Potential issue for UM case thou

This guy says he saw Brewster "chokehold from behind" the dog nonce.

How has Brewster had his charges dropped?

Dog nonce was laying on his back when McBurnie stamped on him. Worth noting that any injuries dog nonce received weren't photographed.

to have a clear view he had to have been one of the people standing adjacent to the defendant yet no evidence of anyone in a stewarding uniform that I saw. He should be capable of being picked out from the video footage

Dog nonce didn't realise he'd been in a choke hold until 10 minutes ago.

Whether the evidence is credible is up to the jury to decide unfortunately. I think it's a load of bollocks, but a jury made of of people who don't see things in the way a football fan on a forum might see things may think differently
Theres no jury. Its a magistrates court.

Would it be completely out of character if McBurnie has done it? I think he was provoked & I think the fan is an absolute tool, but when some attacks you & you see red mist then that person is on the floor infront of you is it completely unrealistic to suggest it could have happened.

No it wouldn't be out of character but you have to go on the evidence submitted to court. The last witness claims to have seen the stamp so I assume it will be challenged,or not, whether he could have seen it

Surely he has to be in court tomorrow for the defence’s questioning?
The defence has already questioned him( see earlier in thread for the 'babes' comment to OM's lawyer and the 'no comment' to a question asked by her)

Not the same I know, but my missis was in Crown court in July this year for a civil case. One of the witnesses against her called her barrister 'Darling.' He was warned by the judge. The next witness then called her barrister 'Love.' He was also warned. The judge mentioned this in his summing up, he wasn't very pleased, and said they'd come close to being charged with contempt of court.

Yeah 100% he's stuck boot in on scab. Whether they can prove it is a different story, given circumstances I don't blame him and I think the whole thing is a farce brought on by the micro cock dog nonce
