The point of successful mediation is that there aren’t winners and losers, it’s about somebody facilitating a reasoned discussion away from the courtroom with a view to reaching a compromise that both sides feel relatively satisfied or at least can live with. If that is possible. The fact that both parties have agreed to it lends at least a small amount of optimism, but it will depend on how they both engage with the process or whether they just see it as a box to tick before recommending the formal legal process. Having been involved in dispute resolution, albeit with one party being HMRC who are usually intransigent cunts, I’ve seen very positive outcomes and complete car crashes.

We don't know what his plans were. We just assume.
That Uzmanov guy from Arsenal just sold his stake in Arsenal for £600m. Word was he was looking at Charlton as a place to invest.

I thought that having made the offer to The Prince he was obliged to accept the same price for the shares, plus market rate for the other assets. So unless he thought he knew that The Prince wouldn’t do that we do know what his plans were don’t we?

The original agreement was that the other side could accept any offer made OR take over for the same amount. HRH made a counter offer but wasn't the same as McCabes. So McCabes offer is off the table.

I do not think this is necessarily correct. The Prince is claiming that McCabe's offer stands and he can have the shares for 5 million, but does not have to buy the property. That remains a possible result of the proceedings I think.
The court will decide but the general principle is that a counter offer in effect negates the original offer as there was no acceptance. HRH's offer is for a different number of shares, so can't be the same. I assume it will be dependent on the wording in the original shareholders agreement.
