I agree, im glad the club are continuing to pursue the matter. This is more encouraging as it is through the High Court, and all documentation has to be shown:)

According to West Sham and the PL, the December document isn't valid, from what I read earlier.

Listening to the radio on my way home yesterday mel somethingorother (Think he's a sports lawyer) was asked regarding the suit if it was possible, and whos "camp" he would rather be in..........................

.........................and guess what, he didnt say west ham's. He is confident that we have the much stronger case and would be very surprised if we didnt get anything out of it
 
A sports Lawyer on SSN who said when we were doing arbortration bollox that we would basically have no chance, is actually backing us to win this says we have a great chance.
 
Joorabchian Offers To Fund Inquiry

Kia Joorabchian insists he would be happy to fund a new inquiry into the Carlos Tevez transfer saga as he searches for "honesty and transparency".

Tevez's representative claims the initial Premier League investigation into the terms of the player's transfer to West Ham in August last year, which ended with the Hammers being found guilty of breaching rules on third-party ownership and being fined £5.5million, was conducted with only "50% of the facts", and wants a new inquiry.

"I don't like the way (Premier League chief executive) Richard Scudamore has, in a roundabout way, made suggestions and dragged me, my players, West Ham and the Premier League through the mud during this period of time," Joorabchian said.

"That's why I want a proper independent inquiry and if the Premier League clubs agree, I'm willing to finance it, whatever it costs. Let's have total transparency Mr Scudamore, we have nothing to hide.

"Why was a full, transparent and thorough investigation not done when your member clubs have a right to know what's happened? Why are they clouding this issue?

"Why were the full facts not heard? Why were people not questioned? They never once asked us about any paperwork, never held discussions with us, never wrote us a letter. How did they decide on a £5.5million fine with only 50% of the facts."

As well as escaping with a fine instead of a points deduction the Hammers were also controversially cleared to continuing playing Tevez for the remainder of the season after writing to Joorabchian notifying him that the club was cancelling the third party ownership agreement.

Joorabchian did not agree to the cancellation but that did not stop Tevez from playing on and scoring the goals that kept the Hammers up and condemned Sheffield United to relegation.

Tevez has now moved on loan to Manchester United after Joorabchian reached an out-of-court settlement with West Ham to release the player from his contract with the London club.

Interesting what he says about them only having only 50% of the facts when they made the decision to punish west ham.

See this was one of the things that got me all along. Why would you not question both parties signed on to a contract before believing it was void?

Mind you there are alot of unanswered questions to say its all meant to be be done and dusted with now.
 
Yes, the interview with Joorabchian, although very interesting, must be taken with a pinch of salt - the guy is a crook, for sure. Also I didn't quite understand the bit he was saying about just West Ham "unilaterally" tearing up the contract as opposed to West Ham and MSI "jointly" tearing up the contract.

Now I'm no business lawyer but I'm pretty sure I can't just tear up my 18 month contract with Orange and expect that to be the end of it.

SHEFFIELD United's decision to pursue West Ham through the courts as they seek financial compensation following the 'Carlos Tevez Affair' could see some of English football's leading figures in the dock.

United, who announced on Thursday that they are sueing the London club for breach of contract, are understood to be claiming damages of around £30m after arguing that by allowing Alan Curbishley’s side to escape a points deduction, the FA Premier League handed them an unfair advantage in the scramble to avoid relegation last season.

United, who dropped into the Championship on the final day of the campaign, have twice tried and failed to force a review of that punishment - imposed when West Ham were found guilty of breaching regulations governing third party ownership of players - and have taken this latest measure in an attempt to force evidence they claim has been withheld from previous investigations.

Bramall Lane officials are understood to be in possession of documents which they believe prove Tevez and his Argentina team-mate Javier Mascherano should never have been allowed to feature for West Ham after holding talks with their representative Kia Joorabchian.

Both players have since joined new clubs but their transfers were delayed as lawyers tried to satisfy FAPL criteria.

Tevez’s move to Old Trafford was the subject of particular controversy when Joorabchian, who has consistently refuted West Ham’s claims, paid them a £2m settlement fee.

Liverpool chief executive Rick Parry attended a previous arbitration panel to explain the processes he had to go through to secure Mascherano’s signature and although he is unlikely to attend any future hearings, the possibility remains that Joorabchian, FAPL chief executive Richard Scudamore and West Ham chairman Eggert Magnusson could also be asked to outline their roles tin the saga.

Do you guys expect Sheff Utd to win this, or do you see it as a last desperate act.

Not trying to get into the whole who was in the right blah blah thing, just wondering if you actually think you will get anything, or is it a case of 'worse case we lose, best case we get £50m, so fuck it?'
 
Can't see us winning it, to be fair. We should have won before, and didn't, so I can't see why this one will be any different.

That's not to say that I don't think we should go for it, mind; I think we should fight tooth and nail, not just for the money, but for justice.
 



thing is, we must have got some new info to go for it. if we had what we had before and it had been turned down we wouldnt get anything.

if its the documents from Kia then, we might get a little compensation.

Sheffield United's dispute with West Ham United over the Blades' relegation from the Premier League last season has gone to arbitration.
West Ham survived after escaping a points deduction, but were fined £5.5m for irregularities over deals to sign Carlos Tevez and Javier Mascherano.

Sheffield United have failed in two previous bids to force the Premier League to relegate West Ham.

The arbitration procedure is understood to be at an early stage.

Sheffield United's relegation from the Premier League was sealed on the final day of the season when they lost to Wigan and Tevez scored West Ham's winner at Manchester United.

Me thinks we should get on with it and stop bitching and moaning about something that happened ages ago. I know they cheated but shouldn't we be concentrating more on on-field affairs?
