Brewster and McBurnie Charged

Think this silly bastard thinks he’s getting a big pay out from McBurnie because he’s a millionaire footballer, unfortunately for him this isn’t America, he’ll be lucky to get more than £500 compensation awarded from the court.
 

100’s or 1000’s of ’fans’ rushing at players 2 of which are coming back from injury may be scared to protect themselves tbh who can blame our players? its been said before but one day it’ll happen when a player will gets seriously hurt or worse, Forest and their fans should be held accountable McBurnie and Brewster should get a full apology you can’t fight anyone who’s not there and the Forest fans shouldn’t have been there in that specific place!
The self-defence defence would have merit were this kid not lying on his back on the floor. Difficult to demonstrate that McB was in immediate danger from him, or had reasonable grounds to believe that to be the case.
 
It's a little concerning that two eye witnesses have categorically stated they saw Oli stamp on him, but the fact that one eyewitness says he had his hood up when he clearly doesn't in any of the videos hardly makes him a credible witness.

The whole thing is a ridiculous and an absolute waste of time and money, but I don't have a good feeling about it.

Depends how you see it I suppose.
If an attacker had just had an unprovoked go at me or my missus and fell to the floor, I think it's reasonable to take him out of action while he's down there in case he got up to do it again.
Mind you, I think it would also have been reasonable to take his head off with a knife and fork.

He got bruised shins from his dogs front paws leaning on them, whilst sucking him off.

Is saying "I had a really badly bruised shin" acceptable as evidence,even to a Magistrates Court?

Not sure tbh.

We're all biased but I can honestly say I have zero sympathy for any football fan receiving a clout for confronting a player on the pitch.

There's obviously limits but I find it ridiculous that this has reached court.

I'd be embarrassed if this was a United fan.

Possibly yes, depending on his job (if he has one) he might have to pay for a solicitor as he may not get legal aid so it might not be a route he wants to go down as he still wouldn’t get much of a pay out for a bruised shin, no big injury to chase him over so the pay out would still not be anything substantial.

Eye witnesses are notoriously unreliable because memory isn’t a true recollection of events but rather a recollection of the narrative you constructed about the incident. Like you say one is already open to being discredited it’ll be interesting to see what the defence do tomorrow.

You’ve missed out the terrible mental anguish which is preventing him from setting foot in a football ground without experiencing great emotional distress. I can only assume he had to change school every time he fell down in the play ground and grazed his knee.

If he uses a no win no fee solicitor it won’t cost him (that’s a caveated comment) and if he got a couple of grand, it’s a couple of grand he otherwise wouldn’t have.
 
Surprised to see McBurnies barrister isn’t even a criminal specialist ? She is a health and safety lawyer ???
She will be used to appearing in courts generally and there clearly is a safety issue here with McB’s work area being invaded.
She would not have taken the brief if she was not confident of doing a good job in a high profile case.
