Whelan is being reported on SSN as being "shoulder to shoulder" with us regarding any legal action we may take and the fact that Middlesbrough have now added their support.

Some sources are saying that seven clubs have added their weight behind legal action but I'm yet to see any hard evidence of it. (EDIT: BBC are reporting seven HERE)

Guess it's a case of wait and see.

Although the premiership need to review there rules and punishments thats for sure.

It should be easy to prove that West Ham own the player, so why don't they just produce the evidence and have done?

That would make us all shut up, but they don't appear willing or able to do it.

Just lay down and let the PL get on with it, despite the fact that a number of clubs believe that they have a strong legal position.

It reads to me as we can take it to the courts so this could legally change the situation of the just finished season.

It prob won't but it could so there is hope of justice.

I repeat... we shouldn't even bother trying? There's a thing called sticking to your principles, which is the right thing to do regardless of the outcome.

Us letting this go away is what the Premier League want. Maybe we won't get any money but we will have made the Premier League think on about the way they operate for the good of the game and made for a very uncomfortable summer for them.

The Chairmen launching this possible action are shrewd businessmen with the best lawyers at their disposal... if you don't mind, I'll listen to what they have to say over you.
 
It wont change the way the Premier League is run it will still be as currupt as always. Us getting some cash off them wont make them think they maybe wrong in there punishment regarding West Ham. There word is final and they will continue to spout "every club agreed to these rules" bollocks. I think us taking legal action will more likely end up in us coming away worse off.

How are we going to come off worse? The only thing that will happen to us is if we lose the case, we will have to pay the court costs, which with the backing of the other clubs, would be shared.

But what would I know, I'm only a law student :rolleyes:

I said I would rather listen to the lawyers than someone who is guessing based on not seeing any evidence whatsoever and not having any legal or indeed football experience whatsoever. I don't see what's wrong with that?

I think what Linz meant was that she feels more inclined to believe the views of the chairmen of these clubs (with more information than any of us), who all happen to be successful business men with plenty of good connections and the money to pay for top lawyers.
 
Whatever happens it wont change a great deal.

The Premier League certainly wont change.

Whelan calls for new Tevez charge

Wigan chairman Dave Whelan wants West Ham to face new charges over the signing of Carlos Tevez.

The Hammers were fined £5.5m for irregularities over the purchases of Tevez and Javier Mascherano but escaped a points deduction.

Wigan have vowed to support relegated Sheffield United in taking action.

"We need a new hearing because he has been registered illegally again. That should be another fine or points deduction," said Whelan.

"We cannot reverse the decision the commission came out with. It is impossible - they we appointed by the Premier League and all the clubs agreed these people would take charge of the case.

"But now we are saying he (Tevez) has been registered illegally for a second time. Who owns him? Where will this £30m be going we are told he is now going for?

"We have to clean all this up. Time is on the side of the Premier League, I have said to Sheffield United that they must get stuck into the League's bones in the next seven days.

"Sheffield United have told me they have a fantastically strong case."

Wigan, Fulham, Charlton and the Blades believe West Ham should have been docked points for acting improperly, while Middlesbrough support the action.

Wigan chairman Dave Whelan attended a meeting on Monday over what action to take.

The Hammers were fined £5.5m but not docked points after being found guilty of acting improperly and withholding vital documentation over the ownership of Tevez and Mascherano, who is now at Liverpool.

Sheffield United chairman Kevin McCabe said he believed more Premier League clubs would join the action.

He told Radio Four's Today programme: "Most of the clubs support the injustice that has come about this season, I would hope we would get the backing of most.

"I feel cheated because yesterday's result was not the root cause of our relegation.

"It will need conversations with chairmen and directors so they understand all of the injustices, so I suspect we will be canvassing.

"If I were on the Premier League board, I would say 'we must address Sheffield United's plight that has come about through no cause of their own'.

"So they need to call their own internal meetings and decide what to do. It is their responsibility to pursue it just as much as it is ours."

Middlesbrough chief executive Keith Lamb confirmed they had raised their concerns over the matter with the Premier League.

"We are not part of any legal action against the Premier League," said Lamb.

"However, in the interests of clarity we are one of several clubs who would like to see evidence that Tevez was correctly registered."

BBC Sport's Garry Richardson said that "two other clubs have joined in and they don't want to be named at the minute".

Latics chief Whelan says they must act quickly.

"Legally, we are being given strong advice that this can be challenged, whatever the Premier League says," he said.

"It can go as far as the House of Lords but the problem there is that it will take too long, next season will be under way by then.

"We must establish whether Tevez was registered in time to play for West Ham and whether they created a new transfer window to sign him.

"But the challenge has to be mounted very, very quickly. Monday and Tuesday are very important days and it has got to be pushed through.

"I feel sadness that Sheffield United went down and we will support them until the end."

West Ham escaped relegation on Sunday after a 1-0 win over Manchester United, with Tevez, ironically, scoring the winner.

United boss Sir Alex Ferguson said he was pleased for Hammers boss and friend Alan Curbishley but admitted he was uneasy over some of the factors relating to the London club's survival.

"I am delighted for Alan but I can't say I am too delighted for West Ham because of all the circumstances surrounding them," said Ferguson.

"I don't want get involved in it. It is not my domain and it doesn't involve Manchester United.

"But I do feel for Sheffield United and I know everyone around the country is looking at the situation with some concern."

It seems we have "a fantastically strong case".

I just hope we aint pissing in the wind with this.

I don't think anything will come of it, and if it does, it will take effect next season as the 06-07 season is now over. (Although the "crime" was comitted at this time).

But why should we back down? If we back down we make it look like we were just after a scapegoat to help us stay up. We carry on with it and we look like we're fighting for justice - which we are. What has happened is SHIT and if it was us we'd have been thrown out of the league for it.

It's happened to lower league clubs many times before - relegated 'cos of shit grounds and banned from being promoted etc - I'm sure the oldies can bring light to this better than I can.

But go for it, Mr McCabe - fight for what you, and we, think is right
 
Well that would be our luck if anything did come of it a punishment would be made next season instead.

It does seem like we are at clutching straws really but if we have a fantastic case then maybe we arnt clutchin straws.

Surely you have looked over it then?

What do you think are chances are realistically?

I feel we should win but we wont the league wont change their mind for me

But i think its going to take too long and go on into the beginning of next season

but we still have some hope which is good to hear

Unlike others, I don't profess to being an expert in areas of which I have no experience.

I have no background in sports law and without all the bits of documented evidence to hand, it is impossible to say how any case would come out.

All I was responding to was Bladesman saying we'd be in a worse off position if we continued with litigation. I said it wouldn't happen because that's not how courts work :)

I think they could get them done for this season if it is sroted quickly but if run into next season will be then

Im prepared to dance naked in the street if West Ham get docked points by fifa for this season. :)
 
Either way if they get docked points then we can claim our share of the Premiership TV and prize money.
That should make it so we are able to buy the players we need to get back into the Prem ASAP.
 



Flippin heck we even Sheffield Wednesday MP's supporing us in the case now. lol
